Convention Refugee

A refugee within the meaning of the Convention is any person who, fearing with reason of being persecuted because of his race, his religion, his nationality, his membership of a social group or his political opinions: either is outside of the country of which he is a national and cannot or, because of this fear, does not wish to claim the protection of that country; either, if she has no nationality, is outside the country in which she had her habitual residence, is unable or, because of this fear, does not wish to return there; and anyone who has not lost their Convention refugee status. The expression "within the meaning of the Convention" refers to the Geneva Convention of July 28, 1951 relating to the Status of Refugees and the Memorandum of Understanding signed in New York on January 31, 1967.
